VDEQ Develops New Financial Assurance Guidance for Solid Waste Facilities

On August 1, 2011, the Virginia Department of Environmental Quality issued new guidance that requires certain solid waste facilities to demonstrate financial assurance for materials that were not covered by the previous financial assurance guidance pertaining to those facilities.  The revised guidance applies to:

  • facilities that store or stockpile materials outside of the landfill footprint area and have not included disposal of this material in the facility closure cost estimate;
  • facilities that store or stockpile materials within the landfill footprint area, but are outside of the vertical design capacity or in cells that have yet to be constructed and have not included disposal of this material in the facility closure cost estimate
  • solid waste management facilities, such as transfer stations, material recovery facilities, or other facilities that are not permitted as a solid waste disposal facility, that store or stockpile materials within the facility boundary.
